Acceptable Use Policy

This Acceptable Use Policy ("AUP") is part of the PropTalon Terms of Service. It applies to you and to everyone you give access to. Breach is grounds for immediate suspension without refund.

1. Prohibited purposes

You may not use PropTalon data, in whole or in part, as a factor in:

• Deciding whether to extend credit, or the terms of credit, to any individual.
• Underwriting or pricing insurance for any individual.
• Screening or evaluating any individual for employment, promotion, reassignment, retention, or volunteer work.
• Screening any individual as a tenant, roommate, or applicant for housing.
• Determining any individual's eligibility for a government benefit or license.
• Locating or assessing an individual for debt collection or judging their ability to pay.

2. Prohibited conduct

• Stalking, harassing, threatening, or intimidating any person, or locating any person against their will.
• Locating or attempting to locate survivors of domestic violence, protected witnesses, or anyone you have reason to believe is hiding for their safety.
• Targeting or excluding property owners on the basis of race, color, religion, sex, familial status, national origin, disability, age, or any other protected characteristic, or on proxies for them.
• Targeting persons you know or should know are under guardianship, cognitively impaired, hospitalized, or in institutional care.
• Foreclosure-rescue, loan-modification, or equity-skimming schemes; deed, title, or quitclaim fraud; forged or misleading instruments.
• Unlicensed brokerage, mortgage, or loan-modification activity, or any activity that requires a license you do not hold.
• Calling, texting, or leaving voicemails for any number without first scrubbing against the national and applicable state Do-Not-Call registries and your internal do-not-call list, or without the consent the law requires.
• Prerecorded, artificial-voice, or automated calls or texts without legally sufficient prior consent.
• Contact outside lawful calling hours, or at a frequency the law prohibits.
• Misrepresenting who you are, why you are calling, or the nature of your offer; failing to honor a stop or opt-out request.
• Scraping, crawling, or bulk-extracting the Service by any automated means, or circumventing rate limits, export caps, or access controls.
• Reselling, sublicensing, publishing, or sharing data outside your workspace, or using it to build or seed another database or product.
• Assembling profiles or dossiers on individuals, combining Service data with other sources to identify or track a specific person, or re-identifying any record we have suppressed.
• Publishing any owner's name, address, or record, including in advertising, social media, testimonials, or screenshots.
• Uploading malware, probing the Service's security, or accessing another workspace's data.

3. Your duties

• Cooperate with suppression: stop using a record once we suppress it, including in exports and downstream systems, and forward removal requests you receive to privacy@proptalon.com within two business days.
• Keep your own consent records, do-not-call list, and outreach compliance documentation; produce them on our reasonable request.
• Report misuse of the Service that you become aware of, including by members of your own workspace.
• Delete all Service data within 30 days after your subscription ends.

4. Enforcement

We monitor usage patterns (search volume, export volume, call outcomes, complaint signals) and act on reports. Depending on severity we may: warn and require corrective action; disable specific features (for example, dialing or exports) for a workspace; suspend the workspace pending review; or terminate immediately and permanently, without refund, and report conduct to carriers, vendors, or authorities where the law requires or permits. Conduct under Sections 1 or 2 that involves fraud, harassment, or safety is terminated on first occurrence.

5. Reporting

To report misuse, or to ask whether a use is permitted, email legal@proptalon.com. Property owners who want a record removed can use proptalon.com/remove.
