Terms of Service

These Terms of Service (the "Terms") govern your use of PropTalon (the "Service"), operated by PropTalon ("we," "us"). By creating an account or using the Service you agree to these Terms. If you do not agree, do not use the Service.

1. What the Service is

PropTalon aggregates publicly available county records and related property information for Florida, applies scoring and AI analysis (including analysis of aerial imagery), and provides workflow tools such as lists, skip tracing, exports, and a dialer. The Service is a research and marketing tool for real-estate professionals.

2. Not a consumer reporting agency

PropTalon is NOT a consumer reporting agency as defined by the Fair Credit Reporting Act ("FCRA"), and the Service does not provide "consumer reports." You may use data from the Service only for direct marketing and investment research. You may NOT use any data from the Service, in whole or in part, to determine a person's eligibility for credit, insurance, employment, housing, tenant screening, government benefits, or any other purpose covered by the FCRA. Violation of this section is grounds for immediate termination without refund.

3. Your communications are your responsibility

The Service includes calling tools and contact data. You are solely responsible for your outreach complying with all applicable laws, including the TCPA, the Telemarketing Sales Rule, federal and state Do-Not-Call regulations, and Florida telemarketing law. PropTalon surfaces DNC indicators as a courtesy; you remain responsible for scrubbing and for obtaining any required consents. Call recording features, where offered, require all-party consent in Florida; you are responsible for complying with recording-consent laws.

4. Accounts and teams

You must provide accurate account information and keep your credentials secure. Team members you invite act under your workspace; you are responsible for their use of the Service. Seats, sweep quotas, trace credits, and dialer numbers are limited per your plan.

5. Billing, trials, and cancellation

Paid plans are billed monthly or yearly through Stripe. New subscriptions begin with a 7-day trial for a one-time $0.99 activation charge; your plan price bills automatically when the trial ends unless you cancel first. Usage-based extras (for example additional sweep credits, skip-trace credits, or phone numbers) are billed as purchased. You can cancel at any time from the billing page; cancellation stops future renewals and your access continues through the paid period. Except where required by law, payments are non-refundable.

6. Acceptable use

You may not: resell, redistribute, or bulk-export the Service's data to build a competing product; scrape or reverse-engineer the Service; use the Service to harass or stalk any person; exceed usage limits by artificial means; or use the Service in violation of any law. We may suspend accounts engaged in abuse.

7. Data accuracy

Public records contain errors and lag; AI analysis (including roof and property-condition assessments) is probabilistic and may be wrong; aerial imagery may predate current conditions. The Service is provided "AS IS" without warranties of any kind. Verify independently before acting on any data point.

8. Intellectual property

The Service, its software, design, and compiled datasets are our property or licensed to us. You receive a limited, non-exclusive, non-transferable license to use the Service for your internal business while subscribed. Your exported lead lists are yours to use consistent with these Terms.

9. Limitation of liability

To the maximum extent permitted by law, PropTalon will not be liable for indirect, incidental, special, consequential, or punitive damages, or lost profits, arising from your use of the Service. Our total liability for any claim is limited to the amounts you paid us in the twelve months before the claim arose.

10. Indemnification

You will indemnify and hold us harmless from claims arising out of your use of the Service, including claims relating to your marketing communications, FCRA-restricted use, or violation of these Terms.

11. Termination

You may stop using the Service at any time. We may suspend or terminate accounts that violate these Terms. Sections 2, 3, 7, 9, and 10 survive termination.

12. Governing law; changes

These Terms are governed by the laws of the State of Florida. We may update these Terms; material changes will be posted here with a new "last updated" date, and continued use constitutes acceptance. Questions: legal@proptalon.com.
